1. Acceptance of these Terms

These Terms of Use govern access to and use of Oyticker, including the website, member areas, market information, analyses, charts, watchlists, community features, private messages, subscription features and any related services (collectively, the “Service”). By creating an account, accessing the Service or using any feature, you agree to these Terms.

If you do not agree, do not create an account or use the Service. Where applicable law grants you rights that cannot legally be waived, those rights remain unaffected.

2. Eligibility and account responsibility

You must be legally capable of entering into these Terms and must provide accurate account information. You are responsible for safeguarding your login credentials, for activity carried out through your account and for notifying Oyticker promptly if you suspect unauthorized access.

You may not sell, transfer, rent, share or otherwise provide access to your account in a way that circumvents account limits, paid access controls or security measures.

3. Financial information only — no investment advice

Oyticker is an information and market-intelligence service. Content available through Oyticker is provided for informational and educational purposes only. It is not personalized investment advice, financial advice, legal advice, tax advice, a recommendation, an offer, a solicitation, a research recommendation or a fiduciary service.

Oyticker does not know your financial situation, objectives, risk tolerance, portfolio, tax circumstances or investment constraints. You remain solely responsible for your trading and investment decisions and for deciding whether professional advice is appropriate.

No content should be understood as a promise or guarantee of performance, profit, price movement, liquidity, execution quality or future market outcome.

4. Market risk and data limitations

Financial markets involve substantial risk, including the risk of losing some or all capital. Prices can change rapidly and may react differently from any analysis, sentiment classification, impact score or expected time horizon shown by Oyticker.

Market data, news, calendars and other information may be delayed, incomplete, unavailable, inaccurate or subsequently corrected. Information displayed as real-time, delayed or historical may also be affected by third-party outages, exchange rules, licensing restrictions, network latency or technical failures.

5. Automated and AI-generated analysis

Oyticker may use automated systems and artificial intelligence to summarize information, classify sentiment, estimate impact, identify instruments, translate content, detect duplicates, moderate community content and generate written analysis. Automated outputs can contain errors, omissions, misclassifications or unsupported inferences.

You must independently verify information that is material to a financial decision. You must not rely on an AI-generated output as the sole basis for placing, modifying or closing a trade or investment.

6. Sources, third-party services and external data

Oyticker may rely on data, infrastructure, content or services supplied by third parties. Oyticker does not control those third parties and does not guarantee their availability, completeness, accuracy, continuity or suitability.

References to companies, securities, indices, currencies, commodities, digital assets or other instruments do not imply endorsement by Oyticker or any relationship with the relevant issuer, exchange or provider.

7. Basic and VIP subscriptions

Oyticker may offer free and paid plans with different access limits. Oyticker VIP is currently offered as a recurring monthly subscription, with the current price displayed on the Plans page and again in Stripe Checkout before payment is confirmed.

Stripe processes subscription payments. Paid subscriptions renew automatically until cancelled. Cancellation is managed from Settings → Manage subscription using the dedicated Cancel subscription control. Unless mandatory law or the checkout terms require otherwise, cancellation takes effect at the end of the current paid billing period.

Cancellation, withdrawal and refund rights remain subject to mandatory consumer law and the Billing & Cancellation policy. Attempting to bypass VIP restrictions, delayed-access controls, content locks or subscription limits is prohibited.

8. Community discussions and private messages

Community posts, comments, images, charts, screenshots, profiles and private messages are user-generated content. They do not represent Oyticker’s views and are not verified or endorsed by Oyticker merely because they appear on the Service.

Users must not post harassment, threats, hate, explicit sexual content, unlawful material, scams, spam, impersonation, market-manipulation schemes, deceptive promotions, confidential information they are not entitled to disclose or content that infringes another person’s rights.

Automated and human moderation may review, restrict, reject, hide or remove content. Moderation can make mistakes and does not guarantee that all harmful, misleading or unlawful material will be detected before another user sees it.

9. Your uploads and content licence

You remain responsible for content you submit. You confirm that you own it or have the rights needed to upload and share it. You must not upload confidential documents, personal data belonging to another person without a lawful basis, copyrighted material you have no right to share or content that violates applicable law.

By submitting content, you grant Oyticker a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transform as technically necessary, moderate and display that content solely as needed to operate, secure and improve the Service and provide the feature in which you submitted it. This licence ends when the content is deleted from active systems, subject to reasonable backups, legal retention duties and security records.

10. Prohibited use

You may not use Oyticker to break the law, manipulate markets, coordinate deceptive trading activity, distribute malware, phish users, scrape or extract data at scale without authorization, reverse engineer protected systems, evade security controls, interfere with the Service, create abusive automated traffic, probe vulnerabilities without written permission or attempt to access another user’s data.

Oyticker may apply rate limits, anti-abuse measures, automated detection, temporary restrictions or account suspension where reasonably necessary to protect users, the Service or third parties.

11. Intellectual property

The Oyticker name, interface, branding, software, original analyses, design, databases, scoring systems and other proprietary material are protected by intellectual-property laws to the extent applicable. Except for rights expressly granted through the Service, no ownership rights are transferred to you.

You may not commercially reproduce, republish, resell or build a competing database from protected Oyticker content without authorization, except where applicable law expressly permits the activity.

12. Moderation, suspension and termination

Oyticker may remove content, restrict features, suspend or terminate accounts when reasonably necessary for security, abuse prevention, non-payment, material or repeated breaches of these Terms, legal compliance or protection of other users. Where required by applicable law, appropriate notice or appeal rights will be provided.

Serious abuse may be reported to relevant service providers or authorities where legally required or reasonably necessary to protect people from harm.

13. Availability and changes to the Service

Oyticker may add, change, suspend or discontinue features. The Service may experience outages, maintenance, data-provider interruptions or errors. Oyticker does not promise uninterrupted or error-free availability.

Beta, demo or experimental features may be changed or withdrawn at any time and should not be treated as production guarantees.

14. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. Oyticker disclaims warranties that may legally be disclaimed, including implied warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability.

Nothing in these Terms excludes a warranty, guarantee or statutory right that applicable law does not allow to be excluded.

15. Limitation of liability

To the maximum extent permitted by law, Oyticker and its operator will not be liable for indirect, incidental, special, consequential or purely economic losses arising from use of or inability to use the Service, including trading losses, lost profits, missed opportunities, loss of data or reliance on delayed, incorrect or incomplete information.

This limitation does not apply where liability cannot legally be limited or excluded, including where applicable law provides otherwise for fraud, intentional misconduct, gross negligence, death, personal injury or mandatory consumer protections.

16. Indemnity for misuse

To the extent permitted by applicable law, you agree to be responsible for losses, claims and reasonable costs caused by your unlawful use of the Service, your material breach of these Terms or content you submit that infringes another person’s rights. This clause does not reduce any mandatory legal protections available to you.

17. Privacy and security

Oyticker may process account, usage, subscription, moderation, security and community data to operate the Service. The Privacy Policy describes the main categories of processing, recipients, international transfers and user rights applicable to the Service.

No internet service can guarantee absolute security. You should avoid posting sensitive personal, financial, authentication or confidential information in community posts or private messages.

18. Changes to these Terms

Oyticker may update these Terms as the Service changes. Material changes will be communicated in a manner appropriate to their significance and, where legally required, consent will be requested again. Continued use after an effective update constitutes acceptance only to the extent permitted by applicable law.

19. Governing law and disputes

These Terms are governed by the law applicable to the Oyticker operator and the user, subject to any mandatory consumer protections that cannot legally be excluded. Users are encouraged to contact Oyticker first at yanisbhbox@gmail.com so that disputes can be addressed directly where possible.
